  4. 9A.52.010. Definitions
  5.  
  6. The following definitions apply in this chapter:
  7.  
  8. /* Sections 1, 2 and 3 are unrelated to computers and are 
  9. omitted. */
  10.  
  11. (4) "Data" means a representation of information, knowledge, 
  12. facts, concepts, or instructions that are being prepared or have 
  13. been prepared in a formalized manner and are intended for use in 
  14. a computer;
  15.  
  16. (5) "Computer program" means an ordered set of data representing 
  17. coded instructions or statement that when executed by a computer 
  18. cause the computer to process data;
  19.  
  20. (6) "Access" means to approach, instruct, communicate with, store 
  21. data in, retrieve data from, or otherwise make use of any 
  22. resources of a computer, directly or by electronic means.

  24. 9A.52.110. Computer trespass in the first degree
  25.  
  26. (1) A person is guilty of computer trespass in the first degree if 
  27. the person, without authorization, intentionally gains access to 
  28. a computer system or electronic data base of another; and
  29.  
  30. (a) The access is made with the intent to commit another crime; 
  31. or
  32.  
  33. (b) The violation involves a computer or data base maintained by 
  34. a government agency.
  35.  
  36. (2) Computer trespass in the first degree is a class C felony.
  37.  
  38. 9A.52.120. Computer trespass in the second degree
  39.  
  40. (1) A person is guilty of computer trespass in the second degree 
  41. if the person, without authorization, intentionally gains access 
  42. to a computer system or electronic data base of another under 
  43. circumstances not constituting the offense in the first degree,
  44.  
  45. (2) Computer trespass in the second degree is a gross 
  46. misdemeanor.

  48. 9A.52.130. Computer trespass- Commission of another crime
  49.  
  50. A person who, in the commission of a computer trespass, commits 
  51. any other crime may be punished for that other crime as well as 
  52. for the computer trespass and may be prosecuted for each crime 
  53. separately.
